Laura Castillo tells us all about Intellectual Property laws

Our Partner Laura Castillo was interviewed by Shine Magazine. Here’s an excerpt:

Today is World Intellectual Property Day, and what better way to commemorate the date than by having a conversation with Laura Castillo, a lawyer specializing in intellectual property. We spoke with her about the current laws in the Dominican Republic in this category, the sanctions involved in violating them, and the process for registering a trademark, something that may interest you if you have a business or an idea you wish to protect. Additionally, she gave us her opinion on the impact of artificial intelligence on copyright, a much-debated topic in the era of ChatGPT.

What led you to specialize in this field of law?

 

It all started when my sister, who is now also a partner, was just starting her law firm specializing in intellectual property. She invited me to help her gain experience while I was studying law. Later, I decided to explore other firms and companies with different focuses, but my heart remained in intellectual property. It never let go even though I tried. I received good offers in other areas, but ultimately chose to focus on what I really liked. That’s how I formally joined my sister’s law firm. The firm will celebrate its 15th anniversary, of which I have dedicated six 24/7.

What types of works are protected under intellectual property law in the Dominican Republic?

In the Dominican Republic, we have two laws. Law 20-00 protects industrial property rights, which include inventions such as patents and distinctive signs such as trademarks. These processes are carried out before the National Office of Industrial Property (ONAPI). On the other hand, Law 65-00 protects copyright, including books, songs, films, and other artistic, literary, and cultural works. These processes are carried out before the National Office of Copyright (ONDA). Both laws exist within the legal framework of intellectual property in our country.
